Equipment Rental Agreement
This Equipment Rental Agreement is a contract between the owner and the renter on a specific booking. Rent Bros ("RentBros," "we," "us") operates the RentBros marketplace at rentbros.com from the Dallas–Fort Worth area, Texas. Rent Bros is not the owner, lessor, or operator of the equipment, and is not a party to the rental, except that you release and indemnify Rent Bros as this agreement says. We do not publish a street address. Email hello@rentbros.com.
The booking is part of this contract
The parties, the equipment, the dates, the price quote, the delivery choice, and the insurance path are the booking record you accept. "Owner" means the account that listed the equipment. "Renter" means the account that sent the request and accepted this agreement. "Equipment" means the item on that listing, including attachments the listing includes. If a date, price, or machine on the booking conflicts with a later chat, the booking record controls unless both of you agree in writing to a change.
You accept this agreement when you check the box on the request. We store the time and the version string. This version is 2026-10-22, effective October 22, 2026. Materials purchases are not this agreement.
What the renter represents
The renter represents that:
- The renter is a qualified, trained operator for this equipment, or will allow only a qualified, trained operator to use it.
- The renter will read the manuals and safety information before use.
- The renter will inspect the equipment before use and will report defects to the owner before use. Do not put a machine to work if the inspection shows it is unsafe.
- Only authorized, qualified operators will use it. No passengers unless the manufacturer designed a seat for them.
- The renter will follow the law, OSHA rules that apply to the job, and the manufacturer's limits, including load, slope, and terrain.
- The renter will not subrent, lend, or assign the equipment.
- Before any digging, the renter will locate utilities and call 811.
- The renter will secure the equipment against theft, including keys, locks, and a reasonable storage location.
Return condition
Return the equipment at the end of the booking, clean, and fueled as the listing requires. Ordinary wear from proper use is excluded. Cuts, impacts, missing parts, contamination, flat tires from misuse, and a fuel tank below the listing's requirement are not ordinary wear. The renter pays the cost to put the equipment back to the pickup condition, aside from ordinary wear.
Loss, theft, and damage
From the moment of pickup, or from delivery handoff if the owner delivers, until return check-in, the equipment is in the renter's care. The renter is responsible for loss, theft, and damage during that time, including the cost of repair, the replacement value if repair is not practical, and the owner's loss of use while it is out of service. This responsibility applies even if someone else caused the loss, unless a later written damage waiver says otherwise. No damage waiver is offered today. See that section below.
Pickup and return record
The owner and the renter will record condition at pickup and at return. Record photos, the hour meter if the machine has one, and the fuel level. Keep those records. If the booking tools give you a place to attach them, use it. A missing record does not erase the renter's responsibility, but photos and meter readings are the best evidence of what changed.
Deposit and card hold
Some equipment uses a refundable security deposit instead of a certificate. The amount is the owner's amount on the listing. If the owner leaves it blank, the suggestion is 10% of the replacement value, at least $150, or $250 when no replacement value is listed. The deposit is not rent and it is not insurance.
When card holds are on, Stripe places a manual-capture authorization for that amount. We store the hold id and status, not the card number. After return check-in, the hold is released except for documented loss, theft, damage, missing fuel, or cleaning beyond ordinary wear. The owner should document the amount with photos or a repair estimate. A placeholder hold, used when Stripe is not available, does not charge a card.
Insurance and certificates
Rent Bros does not sell insurance. The renter brings coverage or a deposit, depending on the equipment.
- A certificate is required for earthmoving, aerial, material handling, trailers, ATVs and UTVs, trench safety, and fall protection. It is also required for equipment with an operating weight of 1,500 lb or more, and for towable or road-going equipment. On compaction, concrete, air, power, pumps, climate, and surface prep, a missing weight is treated as a certificate rental.
- The certificate must show general liability of $1,000,000 per occurrence and $2,000,000 aggregate, and inland marine or other rented-or-leased equipment coverage. It must be unexpired on the booking dates. The renter uploads it and checks those boxes only if the document actually shows them.
- A deposit is the path for traffic safety, signage, flags, barrier tape, fencing, PPE, rigging, site lighting, tools, and storage, and for the weight-gate categories above when the operating weight is under 1,500 lb and the item is not towable.
- On a deposit listing, the owner may allow a valid certificate to skip the deposit. The rental agreement is still required.
- Trucks are not offered until Rent Bros turns that category on. If they are offered, they need a certificate.
- The owner's own policy is the owner's responsibility. Listing on RentBros does not make Rent Bros an additional insured and does not prove the owner's insurer covers a rental to others.
ASSUMPTION OF RISK
THE RENTER UNDERSTANDS THAT CONSTRUCTION AND FARM EQUIPMENT CAN SERIOUSLY INJURE OR KILL THE RENTER, OTHER PEOPLE, AND PROPERTY. RISKS INCLUDE MECHANICAL FAILURE, TIP-OVER, FALLS, ELECTRICAL CONTACT, UNDERGROUND UTILITIES, TRAFFIC, WEATHER, AND THE WAY THE EQUIPMENT IS OPERATED OR MAINTAINED.
THE RENTER VOLUNTARILY ASSUMES THOSE RISKS, INCLUDING RISKS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF THE OWNER OR OF RENT BROS. THE RENTER DECIDES THAT EACH OPERATOR IS QUALIFIED AND THAT THE JOB IS SAFE ENOUGH TO START.
RELEASE AND INDEMNITY
TO THE FULLEST EXTENT ALLOWED BY TEXAS LAW, THE RENTER RELEASES AND DISCHARGES THE OWNER AND RENT BROS, AND THEIR MEMBERS, EMPLOYEES, AND CONTRACTORS (THE "RELEASED PARTIES"), FROM ANY CLAIM, DAMAGE, LOSS, OR EXPENSE ARISING OUT OF THE EQUIPMENT, THE RENTAL, TRANSPORT, OR THIS AGREEMENT.
THIS RELEASE INCLUDES CLAIMS ARISING FROM THE RELEASED PARTIES' OWN NEGLIGENCE, WHETHER THAT NEGLIGENCE IS SOLE, JOINT, CONCURRENT, ACTIVE, OR PASSIVE.
THE RENTER WILL INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM CLAIMS BY THE RENTER OR BY ANY OTHER PERSON ARISING OUT OF THE EQUIPMENT, THE RENTAL, TRANSPORT, OPERATION, OR THIS AGREEMENT, INCLUDING REASONABLE ATTORNEY FEES AND COSTS.
THIS INDEMNITY INCLUDES CLAIMS ARISING FROM THE RELEASED PARTIES' OWN NEGLIGENCE, WHETHER THAT NEGLIGENCE IS SOLE, JOINT, CONCURRENT, ACTIVE, OR PASSIVE.
THIS RELEASE AND INDEMNITY DO NOT APPLY TO A RELEASED PARTY'S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, AND THEY DO NOT APPLY TO A LIABILITY THAT TEXAS LAW DOES NOT ALLOW TO BE RELEASED OR INDEMNIFIED.
Damage waiver
A damage waiver is not offered. Nothing on the site, in a quote, or in this agreement is a loss-damage waiver or insurance. The renter's responsibility for loss, theft, and damage stays in place.
If Rent Bros or an owner later offers an optional heavy-equipment loss damage waiver, it will be a separate written choice under Texas Business and Commerce Code Chapter 93. It will not be required in order to rent. The contract for that waiver will include the statutory notice, the total charge, and the statement that the waiver is not insurance. Until you accept a waiver like that in writing for a specific rental, Chapter 93 does not reduce what you owe under this agreement.
Governing law
Texas law governs this agreement. Venue is the state courts in Tarrant County, Texas, or the United States District Court for the Northern District of Texas, Fort Worth Division. The marketplace Terms of Service still apply to use of the site. Questions: hello@rentbros.com.
