Terms of Service

Effective October 23, 2026. Version 2026-10-23. Contact hello@rentbros.com.

These Terms of Service are a contract between you and Rent Bros ("RentBros," "we," "us"). Rent Bros operates the RentBros marketplace at rentbros.com. We are based in the Dallas–Fort Worth area, Texas. We do not publish a street address. Email us at hello@rentbros.com.

Rent Bros is a marketplace. We help people list construction equipment, farm equipment, and surplus materials, and we help other people request those listings. We are not the owner, lessor, operator, carrier, or insurer of anything listed. We are not a party to the rental or sale between an owner and a renter. The equipment contract is the Equipment Rental Agreement between those two users. A materials purchase is a sale between the seller and the buyer, not a rental.

Eligibility

You must be at least 18 years old to use RentBros. If you use an account for a business, you represent that you have authority to bind that business. You will give accurate information and keep it current. We may refuse, suspend, or close an account that does not meet these terms.

Accounts and verification

One account can both rent and list. You are responsible for what happens under your login. Tell us if you think someone else is using it.

  • We verify a phone number by text message. When text verification is on, Twilio sends the code. We store the number and the time it was verified. We do not store the code itself.
  • We ask for a government ID. Today that is a photo of a driver's license or other ID that our team reviews, usually within a day. You may submit a listing while that review is still pending. If we later turn on a vendor identity check, that vendor may collect the document and a selfie instead of, or in addition to, the photo.
  • ID photos and insurance certificates are private files. They are not public listing photos.
  • A business profile can include a business name, trade, city, and the last four digits of an EIN if you choose to give them. Do not send a full tax ID.
  • Owners connect a bank through Stripe when payout setup is required. Stripe's own terms apply to that connection.

Owner obligations

If you list equipment, you represent each time you submit a listing that:

  • You own the equipment, or you have the legal right to rent it to someone else.
  • The equipment is safe for the use you describe, and you keep it maintained.
  • You will provide manuals and safety information the renter needs, or tell them where that information is on the machine.
  • You will disclose defects, damage, missing guards, and limits you know about. Do not hide a problem in the photos or the description.
  • You keep your own insurance. You have confirmed that your insurer covers this equipment while it is rented to others, or you accept the risk if it does not. Rent Bros does not insure your equipment and does not promise that your policy covers a rental.
  • The price, location, weight, and delivery options on the listing are accurate enough for a renter to decide.
  • If you are a rental yard, you will say so. Yards are labeled.

Surplus materials are a sale, not a rental. You still must have the right to sell them and describe them honestly. Materials do not use the equipment certificate or deposit rules.

Renter obligations

If you request equipment, you agree to the Equipment Rental Agreement for that booking. You will be qualified to operate what you rent, or you will use only a qualified operator. You will inspect before use, follow the law and the manufacturer's instructions, and pay for loss, theft, or damage while the equipment is in your care. You will not use a listing to get equipment you do not intend to rent under that agreement.

Heavy or road-going equipment needs a certificate of insurance before the owner can accept the request. Smaller equipment uses a refundable security deposit. The listing and the rental agreement state which path applies. Rent Bros does not sell that insurance.

Fees and payments

The price you see on a request is an estimate from the published fee schedule. Both sides see the same quote. Money is calculated in cents.

  • Equipment: the renter pays a service fee of 6% of the rental subtotal.
  • Equipment: the owner's commission is 9% of the rental subtotal. A founding owner pays 0% commission for 90 days, then 9%.
  • Surplus materials: an 8% fee comes out of the seller's side.
  • Delivery, if the listing charges for it, is shown on the quote.

Sending a request does not capture the rental price. There is no separate "paid" state on a request. Card payments run through Stripe. We do not store full card numbers. On deposit-path equipment, we may place a refundable card hold for the security deposit through a Stripe PaymentIntent that is authorized and not captured up front. If Stripe is not available for that hold, the request can still be stored with a placeholder hold so the owner can see it, and no card is charged for that placeholder.

A damage waiver is not offered. No damage-waiver fee is charged. Rent Bros is not an insurer.

Payouts

Owners who need payouts connect a bank with Stripe Connect Express. Stripe chooses the account configuration. On that product, Stripe is the fees collector and the losses collector (Stripe's managed-risk terms). Stripe hosts the Express Dashboard. Rent Bros does not hold rental proceeds as a captured charge at the time of the request, and we do not promise a payout date. When a rental is actually paid, Stripe pays the connected account under Stripe's agreement and its timing rules. You must finish payout setup before we can treat a listing as ready when live payouts are on.

Cancellations and no-shows

This schedule is a working default. Rent Bros may adjust it by posting a new version of these terms. A change applies to requests sent after that version's effective date. It does not rewrite a booking that already recorded an earlier version of the Equipment Rental Agreement.

  • Before the owner accepts, either side may cancel, and the owner may decline. Rent Bros does not charge a cancellation fee.
  • After the owner accepts, the renter may cancel. If you cancel at least 24 hours before the start date on the booking, a deposit hold should be released, except for a documented delivery cost you already agreed to.
  • If you cancel inside 24 hours of the start, or you do not show up for pickup or delivery, the owner may apply the deposit to documented loss, including a reasonable lost rental day, as the Equipment Rental Agreement allows.
  • Rent Bros does not charge its own cancellation fee on top of that.

Listing review and takedown

A new listing stays in review until we publish it. Sample listings are fictional and labeled. We may refuse a listing, pause it, restore it, or delete it. We may also suspend an account. Reasons include safety, a false description, missing insurance information, a prohibited use, or a legal request. Deleting a listing is blocked while a booking request is still tied to it. Public search shows published listings only.

Prohibited uses

You will not:

  • List equipment you do not own or have no right to rent, or materials you have no right to sell.
  • Hide a defect, or post photos that misstate the condition.
  • Upload a false insurance certificate, or check coverage boxes that the certificate does not show.
  • Use rented equipment in a way that breaks the law, the manufacturer's limits, or the Equipment Rental Agreement, including subrenting it.
  • Harass another user, or use the site to commit fraud.
  • Scrape, probe, or overload the service, or try to get another person's account, ID photo, or certificate.
  • Send a full tax ID, or upload anything you do not have the right to share.

Sales between users

Some listings are for sale, for rent, or both. A sale is a contract between the buyer and the seller. Rent Bros is not the seller, not a party to the sale, and not a broker of the item. We do not hold the purchase money, and we do not transfer title or registration.

  • Items are sold as is unless the seller states otherwise in writing on the listing or in a message tied to that sale.
  • The buyer inspects the item before paying. A buy now request or an offer does not charge a card. The buyer and the seller arrange payment and pickup themselves.
  • The seller confirms they own the item free of liens, or they disclose any lien in the listing before the buyer pays.
  • Title and registration for a vehicle, trailer, or other titled item are the buyer and seller's responsibility.
  • An offer can expire, be declined, or be countered once. Accepting one offer or buy now request takes the listing off the market while that sale is pending. The seller can mark it sold or put it back up.
  • The seller fee on a sale, when a price is shown, is 8% of the sale price from the seller side. It is not added to the buyer's price. Nothing is collected online at this time.

Disputes between users

Disputes about the equipment, a pickup, damage, a deposit, or a no-show are between the owner and the renter. Rent Bros is not required to decide them. We may share the booking record, photos, and messages with the users on that booking, and with a payment processor or an insurer when that is needed to handle a hold, a claim, or a legal duty. You should try to resolve the dispute with the other person first.

Disclaimer of warranties

THE MARKETPLACE, THE SITE, AND THE LISTINGS ARE PROVIDED AS IS AND AS AVAILABLE. TO THE FULLEST EXTENT ALLOWED BY TEXAS LAW, RENT BROS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT A LISTING, A USER, A CERTIFICATE, OR A PIECE OF EQUIPMENT IS SAFE, ACCURATE, OR AVAILABLE. We do not inspect every machine. An owner's description is the owner's, not ours.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY TEXAS LAW, RENT BROS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST RENT, OR PERSONAL INJURY, ARISING OUT OF THE SITE, A LISTING, OR A RENTAL, EVEN IF WE HAVE BEEN TOLD THOSE DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR A CLAIM ARISING OUT OF THESE TERMS OR THE MARKETPLACE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO RENT BROS IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). Fees you pay the owner, a deposit hold, and amounts Stripe handles as losses collector are not fees paid to Rent Bros.

This cap does not limit liability for our gross negligence or willful misconduct, or any liability Texas law does not allow us to limit. The Equipment Rental Agreement has its own release between you, the owner, and Rent Bros for the rental itself.

YOUR INDEMNITY OF RENT BROS

YOU WILL INDEMNIFY, DEFEND, AND HOLD HARMLESS RENT BROS AND ITS MEMBERS, EMPLOYEES, AND CONTRACTORS FROM CLAIMS, DAMAGES, LOSSES, AND REASONABLE ATTORNEY FEES ARISING OUT OF YOUR LISTING, YOUR RENTAL, YOUR EQUIPMENT, YOUR MISUSE OF THE SITE, OR YOUR BREACH OF THESE TERMS, INCLUDING A CLAIM BY THE OTHER USER ON A BOOKING.

THIS INDEMNITY INCLUDES CLAIMS ARISING FROM RENT BROS' OWN NEGLIGENCE, WHETHER THAT NEGLIGENCE IS SOLE, JOINT, CONCURRENT, ACTIVE, OR PASSIVE, TO THE EXTENT TEXAS LAW ALLOWS THAT INDEMNITY.

THIS INDEMNITY DOES NOT APPLY TO RENT BROS' GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

Governing law and venue

Texas law governs these terms, without regard to conflict-of-law rules. Exclusive venue is the state courts in Tarrant County, Texas, or the United States District Court for the Northern District of Texas, Fort Worth Division. You consent to personal jurisdiction in those courts.

Changes

We may change these terms by posting a new version on this page with a new effective date and version string. The version in effect on October 23, 2026 is 2026-10-23. If you have an account, continuing to use RentBros after the new effective date means you accept the new terms for new use of the marketplace. A booking keeps the Equipment Rental Agreement version recorded when you accepted it. The rental agreement version stays 2026-10-22 unless that agreement itself changes. If you do not agree to a change, stop using the site.
